Welcome to ShopeMart. By accessing or using shopemart.com.bd, our retail shops, or any related service (together, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. Using ShopeMart
You must be able to form a legally binding contract to use the Service. You are responsible for keeping your account password confidential and for all activity under your account. Tell us right away if you suspect unauthorized use of your account.
2. Orders and Payment Placing an order is an offer to buy; we confirm the order once we accept it. Prices, availability, and delivery estimates shown on the Service may change without notice until an order is confirmed. We accept the payment methods shown at checkout, including Cash on Delivery and mobile financial services (e.g., bKash). You must provide accurate delivery and payment information. Orders may be limited, refused, or cancelled at our discretion, for example for suspected fraud, pricing errors, or stock unavailability — in which case any payment already made will be refunded. 3. Marketplace, Vendors and Resellers
Some products on the Service are listed by independent vendors, and some orders are placed through independent resellers. ShopeMart is not the manufacturer of vendor-listed products; the listing vendor is responsible for the accuracy of their product information. ShopeMart coordinates payment, delivery, and customer support for these orders.
4. Delivery, Returns and Refunds
Delivery times shown are estimates, not guarantees. Our return, exchange, and refund rules are shown on the relevant order/product pages and in our Policies section, and apply in addition to your rights under applicable Bangladeshi consumer protection law.
5. Loyalty Points and Offers
Points, coupons, and promotional offers are provided at our discretion, have no cash value, may expire, and may be changed, limited, or withdrawn at any time, except for points or coupons already earned or issued to you.
6. Communicating With Us
You may contact us, or a shop on our platform, through the Service, by phone, or through Facebook Messenger, Instagram, or WhatsApp. Messages sent this way are handled by our own support team using our own tools, as described in our Privacy Policy.
7. Prohibited Conduct
You agree not to: use the Service for any unlawful purpose; interfere with or disrupt the Service; attempt to access accounts or data that are not yours; post false, misleading, or infringing content; or resell access to the Service without our written permission.
8. Intellectual Property
The ShopeMart name, logo, and the Service's design and software belong to ShopeMart or its licensors. Product images and descriptions supplied by vendors remain the property of those vendors. You may not copy, modify, or redistribute any part of the Service without permission.
9. Disclaimers and Limitation of Liability
The Service is provided "as is". To the fullest extent permitted by law, ShopeMart is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits any liability that cannot be limited under applicable law.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms. The "Last updated" date above will reflect the latest revision.
11. Governing Law
These Terms are governed by the laws of Bangladesh. Any dispute will be subject to the exclusive jurisdiction of the courts of Bangladesh.
